By creating an account, accessing, or using Datum Tools (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

What Datum Tools is

Datum Tools provides software tools for early-stage architectural feasibility, massing, code-reference lookup, and construction cost estimation. The Service performs automated calculations based on user-entered inputs and published reference data (including building code tables and cost benchmarks). It does not involve review by a licensed architect, engineer, or other professional, and its outputs are not construction documents, permit submissions, code compliance determinations, appraisals, or financing-grade estimates of any kind.

No professional advice

Datum Tools does not provide architectural, engineering, legal, or financial advice. Using the Service does not create an architect-client, engineer-client, or other professional relationship between you and Datum Tools Org. Nothing in the Service should be read as a recommendation to take or not take any specific design, construction, financial, or business action.

Your responsibility

You are solely responsible for independently verifying every result produced by the Service with a licensed architect, engineer, or other qualified professional before using it for construction, permitting, financing, or any decision affecting safety, property, or investment. You retain sole control over, and sole responsibility for, all decisions, conclusions, or actions you take based on your use of the Service.

Subscriptions and purchases

Full access to Datum Tools is available either as a one-time purchase or as a monthly auto-renewing subscription, at the price shown in the app at the time of purchase.

For the auto-renewing subscription: payment will be charged to your Apple ID account (or Google Play account, on Android) at confirmation of purchase. The subscription automatically renews for the same one-month period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current subscription price. You can manage your subscription and turn off auto-renewal at any time in your Apple ID (Settings > [your name] > Subscriptions) or Google Play account settings — Datum Tools Org cannot cancel a subscription on your behalf. Any unused portion of a free trial period, where offered, will be forfeited when you purchase a subscription.

Prohibited use

You may not use the Service, and no output of the Service may be used, as the sole or primary basis for: construction documents or permit submissions; code compliance certification; appraisals, underwriting, or financing decisions; or any decision in which reliance on an unverified estimate could lead to personal injury, death, or significant property or financial loss — without independent verification by a qualified licensed professional.

No warranty

The Service and all results are provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Datum Tools Org does not warrant that any result will be accurate, complete, or error-free, or that the Service will operate uninterrupted or be secure.

Limitation of liability

To the maximum extent permitted by law, Datum Tools Org will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or the cost of a failed construction, permitting, or financing decision, arising from your use of or reliance on the Service. Datum Tools Org's aggregate liability for any claim arising from these Terms or your use of the Service will not exceed the greater of (a) one hundred dollars (US$100) or (b) the total amount you paid Datum Tools Org in the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Datum Tools Org from any claim, loss, or damage arising from your use of the Service in violation of these Terms, including any reliance on Service outputs without the independent professional verification described above.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles.
